| The Board of Directors of Malton Berhad wishes to inform that, on 29 April 2010, Ho Hup Construction Company Berhad (“Plaintiff”) had served a legal suit filed in the Kuala Lumpur High Court (“Court”) in respect of the JDA on Pioneer Haven Sdn Bhd (“PHSB”) amongst others, seeking inter alia, a declaration that the JDA is void and to expunge the private caveat lodged by PHSB pursuant to the JDA on a piece of land held by Bukit Jalil Development Sdn Bhd under individual title Geran 42277, Lot No. 36101, Mukim of Petaling, Daerah Kuala Lumpur, Negeri Wilayah Persekutuan.
An injunction application which was also filed by the Plaintiff was heard on 5 May 2010, and the judge granted an interim order restraining PHSB from acting on the JDA. The inter-parte injunction application is fixed for hearing on 17 & 18 June 2010. PHSB will be filing and serving the affidavit in reply within 14 days from 5 May 2010 as directed by the Court.
